The Terms of Business determine the terms of use of the online store on the galex.si website (hereinafter referred to as the “online store”), which is operated by Galex doo, Tišinska ulica 29g, 9000 Murska Sobota , which is also a provider of e-commerce services (hereinafter referred to as the “provider”).

The terms and conditions of the online store are drawn up in accordance with the Consumer Protection Act (ZVPot-1) , recommendations of the Chamber of Commerce and Industry , the General Data Protection Regulation (GDPR), the Electronic Communications Act (ZEKom-1) and the Electronic Commerce on the Market Act (ZEPT) .

The online store allows you to purchase dietary supplements, cosmetics and other products remotely.

An online store user is an individual who visits the online store and has the right to make a purchase. A buyer is a user who makes a purchase through the galex.si online store.

Please read the general terms and conditions of the online store carefully, as they are binding on you from the moment you enter our online store. With each transaction made through our online store, you are deemed to be familiar with the full content of the general terms and conditions and to have agreed to the offered general terms and conditions without any restrictions.

The Provider reserves the right to make any changes to the general terms and conditions without special notice. The changes are effective from the moment of publication and are binding on the user. The provision of the previous paragraph does not apply if these terms and conditions or essential components of the contract change during the purchase process – in this case, the Provider will inform the buyer of this and allow him to withdraw from the contract.

The online store is open every day, 24 hours a day. Due to various technical reasons, it is sometimes not possible to conduct business through the online store or even access the store. Therefore, the provider reserves the right to limit or completely stop the sale of some or all products for a certain or indefinite period of time or to limit or completely stop access to the online store pages for a certain or indefinite period of time.

Purchase process

Purchasing products from the online store is simple and takes place in the following steps:

  1. Product selection

Description of the steps of the purchase process

I. Product selection: On the website www.galex.si, select the product and click on the “Add to cart” link. The system will inform you that the product has been successfully added to the cart. If you want to continue shopping, click on the “Close” cross in the top right and you will return to the online store. If you want to complete your purchase, click on the “View cart” link below and the system will take you to the shopping cart.

II. Removing a product from the shopping cart: On the website www.galex.si, in the upper right corner, there is a shopping cart icon, in which (after clicking on the icon) the user is shown the products that they have added to the shopping cart while browsing the online store. If the user wants to remove a specific product from the shopping cart, they must click on the cart icon “cross” or the “+” sign to increase or “-” to decrease the quantity of products they want to order. If the user wants to add a specific product to the cart, they must click on the “Close” cross in the upper right corner. By clicking on the said cross, they return to the online store.

III. Shopping cart: To complete your order, you must click on the “Continue to checkout” icon and fill in the required fields.

Payer information: You must provide the required contact information marked with a red asterisk (first name, last name, country/region, street, city, postal code, telephone, email address), which we need to confirm and complete the order and deliver the product.
Delivery: Delivery is carried out by Pošta Slovenije and GLS. You can choose delivery to a different address.
Payment method: You can choose from four payment methods: Direct bank transfer, Cash on delivery, Paypal payment or credit card (Stripe).
Order details: Displays the products that the user added to the shopping cart while browsing the online store, the product price, delivery cost, payment method, and the total amount and VAT amount.

IV. Completion of the order: The user can review the submitted delivery information, the payment method he has chosen and the contents of the shopping cart. The user confirms the order by clicking on the ‘Buy Now’ button. If the order was successfully completed, the text “Your order was successful. Thank you for your purchase!” is displayed on the website. The “Complete Order” page displays information about the order number, date, buyer’s email address, purchase amount, payment method, details of the bank account for the transfer, order information, payer information and delivery address.

Purchase notification process

After placing an order, the buyer receives a notification by email that the order has been accepted.
Galex may call the customer on their contact telephone number to verify data or to ensure the accuracy of delivery.
The purchase process for legal entities is exactly the same as for individuals, except that at the end of the purchase, you must enter the company name and company tax number. The payment options are also the same.

Ordering – concluding a distance contract

The purchase contract between the provider and the buyer is concluded at the moment of confirmation of the order by the provider (at the moment of receiving the email message: “Your order on galex.si has been accepted!”).

The concluded order/contract is stored by the provider in electronic form. Contracts and invoices are stored in accordance with the legislation and are available to buyers at the provider’s headquarters in case of a request (a few days before the viewing). Buyers can request a copy in pdf format via our contact address info@galex.si . For copies of contracts (invoices, delivery notes) that are older than two years, we may charge a fee for issuing.

Accepted orders are considered irrevocable. The buyer may cancel the order without additional obligations between the time the order is placed and the time the order is processed.

Payment methods

The galex.si online store offers modern electronic payment systems. All payments are made via secure connections. All payments are integrated and approved by payment providers. Data transmission is used in encrypted mode, credit card information is protected.

A mandatory requirement for all EU members is PSD2, or the EU Payment Services Directive 2 , which sets out how all online and mobile payments must be handled in the EU. Among other things, the law requires strong user authentication (SCA). How strong user authentication is implemented depends on the bank or payment provider.

We offer the following payment methods:

  • Payment by pro forma invoice (direct bank transaction): The buyer receives a pro forma invoice to their email address as soon as possible. The payment deadline is two days from the date on the pro forma invoice. After payment of the pro forma invoice, the order is shipped to the delivery address.
  • Cash on delivery: the buyer pays the purchase price upon delivery.
  • Paypal.
  • Payment by credit cards (Maestro, Activa Maestro, MasterCard, Visa, Visa Electron, Diners Club) – Stripe.

All prices in the online store are in euros and include VAT (value added tax).

Prices are valid at the time of placing the order and have no predetermined validity. Prices are valid in the case of payment using the published possible payment methods.

Deadline and delivery of ordered products

The contractual partners for delivery of shipments are Pošta Slovenije (standard delivery) and GLS (standard delivery and parcel machines). We reserve the right to choose another delivery service if this allows us to fulfill the order more efficiently. Delivery costs are charged to the buyer at the time of purchase.

The buyer covers the shipping costs themselves if the purchase amount is less than €50, otherwise the shipping costs are FREE. The delivery cost in Slovenia is €3.90 (including VAT) and will be displayed at the completion of your order and will be listed on the invoice that you will receive together with the ordered products. The shipping costs are calculated according to the currently valid price list of Pošta Slovenije and GLS. The surcharge for payment upon receipt (upon receipt) is €1.

The final delivery to your address depends on the situation at Post Slovenije and GLS.

Slovenian Post and GLS offer you fast and reliable delivery. The postman or delivery person will deliver the package to your chosen delivery address within 2-3 days. All orders placed on weekdays by 1 p.m. are shipped the same day if paid by credit card or Paypal. Orders marked as pre-invoiced are shipped as soon as we receive the transfer to the company’s bank account. Orders placed on weekends and holidays are shipped the next business day. In exceptional cases, the delivery time may be extended, so please write this in the notes when placing the order if you want to receive the shipment as soon as possible.

Warning: Delivery of products under these conditions and delivery costs apply only within the Republic of Slovenia.

The retailer enables purchases to all customers from other EU member states under the same conditions as Slovenian customers.

If you would like to order our products in Slovenia, but want them delivered to an area outside the territory of the Republic of Slovenia, the costs and delivery time are:

Zone 1: 13.00 EUR (VAT included) – Austria, Germany, Luxembourg, Netherlands, Belgium, Italy, Denmark, Hungary, France, Poland, Czech Republic, Slovakia, Lithuania, Monaco and Croatia. Products will be delivered within 2-5 days

Zone 2: 30.00 EUR (VAT included) – Romania, Spain, Sweden, Estonia, Latvia, Finland, Serbia, Portugal, Switzerland, GBR, Ireland, Greece, Turkey, Bulgaria, Norway. Products will be delivered within 2-7 days.

The buyer covers the shipping costs themselves if the purchase amount is less than €150, otherwise the shipping costs are FREE.

The products will be delivered in appropriate packaging that will ensure the safety of the product’s nature. Please read the leaflet carefully before use! Consult your doctor or pharmacist about the risks and side effects.
Safety data sheets for chemicals, including substances, preparations and biocidal products, are available upon special request from the published contact.

If upon receipt of the shipment it is noticeable that the item or package is physically damaged, missing contents or shows signs of opening, the buyer must immediately initiate the complaint procedure and notify Galex doo. Together with the delivery service, we will ensure that the complaint is resolved as soon as possible.

Issuance of invoice After delivery and payment of the ordered items, Galex doo will also send the buyer an invoice by e-mail. The invoice will detail the price and all costs related to the purchase. The buyer is obliged to check the accuracy of the data.

Discount codes

A discount code or promotional code brings various benefits when purchasing through the online store www.myelixire.com. You can find the active code on the cover page of the advertising message, in an email from Galex doo or in other media. The code brings various benefits, from various gifts to discounts. Any code is always time-limited and must be used within a limited specified period, otherwise it is invalid.

Using the discount code:

  • Select the products you want to purchase and add them to your cart.
  • When completing your purchase, there is a box where you enter a “discount code” and click the “apply” button.
  • Only one discount code can be used per purchase.
  • Promotions, discount codes and free shipping are not cumulative and are mutually exclusive.
  • When you enter a discount code, the value of the discount code is automatically deducted from the price of your order, leaving the remaining amount that needs to be paid.

The consumer’s right to withdraw from the contract

The consumer (this applies exclusively to natural persons who purchase an item for purposes outside their commercial activity) has the right to notify the seller of his withdrawal from the contract within 14 days of receipt of the item, without having to give a reason for his decision. The period begins one day after the date of receipt of the item.

In the event of withdrawal from the contract, the consumer returns the received item(s) by mail to the seller’s address: GALEX doo, Tišinska 29 g, 9000 Murska Sobota.

The consumer must return the goods or item to the seller unused, undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer. The consumer may not use the items without hindrance until withdrawal from the contract. The consumer may inspect and test the items to the extent strictly necessary to determine the actual condition. The consumer is liable for any reduction in the value of the goods if the reduction is the result of conduct that is not strictly necessary to determine the nature, properties and functioning of the goods.

The only cost borne by the consumer in connection with the withdrawal from the contract is the cost of returning the item(s) (which, in the case of shipping, is charged according to the price list of the delivery service and depends on whether it is a shipment or a package). In sales contracts, the company may withhold the refund of payments received until the returned goods have been received or until the consumer provides proof that he has sent the goods back, unless the company offers the option of collecting the returned goods himself.

The consumer does not have the right to withdraw from the contract in contracts whose subject matter is an item that was manufactured according to the consumer’s precise instructions, that was adapted to his personal needs, that is not suitable for return due to its nature, that is perishable or that has already expired, as well as in contracts whose subject matter is sealed goods that are not suitable for return for health or hygiene reasons, if the buyer has opened the seal after delivery.

The refund of payments made will be made as soon as possible, but no later than 14 days from the receipt of the notice of withdrawal from the contract. The company will return the payment received to the consumer using the same means of payment as the consumer used (which is most commonly by payment to a transaction account), unless the consumer has explicitly requested the use of a different means of payment and the consumer does not bear any costs as a result.

When withdrawing from a contract in which a bonus, discount code or promotional code was used, these funds are considered a discount and are not returned to the user. Only the amount paid is returned to the user.

In exceptional cases, when items are not returned in accordance with the Consumer Protection Act (ZVPot), we may offer the consumer the purchase of the item with appropriate compensation, which is determined in the minutes upon return. The purchase with a reduced value is taken into account upon confirmation by the consumer via email. The consumer uses the aforementioned purchase price exclusively when ordering another item of the same or higher value.

The right to a refund in the event of warranty claims and material defects is more precisely regulated by the provisions of the applicable consumer protection law.

Consumer withdrawal from the contract for items from a set

Products in a set constitute a single item. This means that the same terms and conditions apply to withdrawal from the contract for items in a set as set, except that withdrawal can only be exercised for the entire set and not for individual items in the set.

Complaints and returns of ordered products

All products are inspected and shipped undamaged before delivery. We will carefully pack your products in a delivery box so that they reach you undamaged and in their original packaging. In accordance with Article 37 of the Consumer Protection Act, in the event of a possible defect in the product, the buyer has the right to request that the company replace the defective product with a new, flawless product or refund the amount paid or eliminate the defect in the product or refund a part of the amount paid in proportion to the defect. If the buyer receives incorrect or damaged products, they can return them free of charge to the provider’s address: Galex doo, Tišinska ulica 29G, 9000 Murska Sobota within 8 days of receiving the goods.

Product replacement

The exchange of purchases made through the online store is carried out by the online store galex.sii . Products must be unopened, unused, unchanged in quantity, undamaged and in their original packaging. The deadline for exchanging products is 8 days. Product exchanges are only possible upon presentation of an invoice or a copy of the invoice. Products can only be exchanged for other products. A refund (partially or in full) is not possible in the event of an exchange. If the new products exceed the value of the exchanged products, the buyer must pay the difference in price.

Factual error

The seller must deliver the goods to the consumer in accordance with the contract and is liable for material defects in its performance.

When is a mistake real? When:

  • the item does not have the properties necessary for its normal use or circulation,
  • the item does not have the properties necessary for the specific use for which the buyer is purchasing it, but which were known to the seller or should have been known to him,
  • the item does not have the properties and characteristics that were explicitly or tacitly agreed or prescribed,
  • the seller delivered an item that does not match the sample or model, unless the sample or model was shown only for the purpose of notification.

The provisions of the law governing contractual relations shall apply to liability for material errors, unless otherwise provided by that law. No contractual provision can limit or exclude the seller’s liability for material defects, as defined in the Consumer Protection Act. Material defects are resolved in favor of the consumer in accordance with Articles 37-39, which are defined in the Consumer Protection Act (Official Gazette of the Republic of Slovenia, No. 98/04 – official consolidated text, 114/06 – ZUE, 126/07, 86/09, 78/11, 38/14, 19/15, 55/17 – ZKolT and 31/18).

How is the suitability of an item checked?

It is checked with another, flawless item of the same type, as well as with the manufacturer’s statements or statements on the item itself.

How is a factual error enforced?

  • The consumer may exercise his rights arising from a material defect if he notifies the seller of the defect within two months from the date on which the defect was discovered.
  • The consumer must accurately describe the defect in the defect notification and allow the seller to inspect the item.
  • The consumer can notify the seller of the defect in person, for which the seller must issue a receipt, or send it to the store where the item was purchased, or to the seller’s representative with whom the contract was concluded.
  • The seller is not liable for material defects in the goods that become apparent after two years have passed since the item was delivered.

A consumer who has properly notified the seller of the defect has the right to require the seller to:

  • eliminate the defect in the goods or refund a part of the amount paid in proportion to the defect or
  • replace the defective goods with new, flawless goods, or
  • refund the amount paid.

In any case, the consumer also has the right to demand compensation from the seller for damages, in particular reimbursement of the costs of materials, labor, transfer and transportation of products incurred due to the fulfillment of the obligations referred to in the previous paragraph of this article.

The consumer’s rights to assert a material defect expire two years after the date on which he notified the seller of the material defect.

For the avoidance of doubt, items from a set are treated as a single product (as a set), therefore, in the event of a material defect, the same terms and conditions as set out above apply to items from a set, whereby, in the event that an individual item from a set has a material defect, the consumer may request the provider to replace only the individual item from the set, but may not request a refund for that individual item.

Products out of stock

Products marked “Out of stock” cannot be ordered. If any of the products you have ordered are out of stock, we will notify you. At that time, you can cancel the order in full, confirm a partial order, or confirm that you will wait until the product is back in stock. We apologize for any inconvenience this may cause you.

Security

Shopping and paying through the online store is safe. All payments made with a payment card are processed in real time for your safety with immediate verification of data with banks. You can make a payment with a payment card (Maestro, Activa Maestro, MasterCard, Visa, Visa Electron, Diners Club).

Limitation of liability

Due to the nature of business via the World Wide Web, the online store’s offerings change and are updated quickly and frequently. Despite our efforts to provide up-to-date and accurate information on the galex.si online store, the possibility of incorrect information about price or availability cannot be ruled out.

In these rare cases, or in cases where the price or availability status of the supplier changes during the order processing itself, the provider will allow the buyer to withdraw from the purchase or offer the best possible solution to the situation.

All promotions and discounts published on the online store are valid exclusively for purchases or orders made online.

Our offer does not encourage excessive shopping or uncritical use of products. When using products, you must adhere to the recommended dosages and instructions for use.

Complaints, claims and disputes

The trader makes every effort to fulfill its duty to establish an effective complaints handling system and to designate a person with whom the buyer can contact by phone or e-mail in case of problems. In the case of a phone call to the trader’s communication number, the buyer is only charged the basic price of a telephone conversation charged by the telecommunications operator. The buyer’s complaint or other request is submitted via e-mail to the trader’s e-mail address info@galex.si or in writing to the trader’s address specified in the general terms and conditions. The procedure for handling the complaint or request is confidential.

The trader will acknowledge receipt of the complaint within five working days of receiving it, inform the buyer of the time it will take to process it and keep him informed of the progress of the procedure. The trader is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute in court. Therefore, the trader will make every effort to resolve any disputes amicably.

Law and jurisdiction of the courts

These general terms and conditions are governed by the law of the Republic of Slovenia.

Out-of-court settlement of consumer disputes

The trader warns that it does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer might initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act.
